1. Who We Are

QuickDown is a file hosting service operated from the Netherlands. Contact: legal@quickdown.nl

2. Acceptance

By using this service you agree to these terms. You must be at least 16 years old (GDPR minimum age for the Netherlands).

3. Prohibited Content

You may not upload content that is illegal under Dutch or EU law. This includes but is not limited to:

• Child sexual abuse material (CSAM) — reported immediately to police and NCMEC
• Malware, viruses, or exploit code
• Content that infringes third-party copyright
• Non-consensual intimate imagery
• Content promoting terrorism or incitement to violence

4. Our Rights

We may remove content and suspend or terminate accounts that violate these terms, at any time without prior notice. For serious violations we will cooperate with law enforcement.

5. Your Content

You retain ownership of files you upload. By uploading, you grant us a licence to store and serve your content solely to provide this service.

6. No Warranty / Liability

The service is provided as-is. We are not liable for data loss, downtime, or damages arising from use of the service. Do not rely on us as your sole backup.

7. Takedowns (DSA / Copyright)

To report illegal content or a copyright infringement, email abuse@quickdown.nl with a description and the file URL. We will act on valid notices without undue delay as required by the EU Digital Services Act.

8. Content Investigation & Legal Hold

When content is reported for serious violations (including but not limited to CSAM, illegal material, or malware), we are required by law to preserve that content and associated data for the duration of any investigation. During this period:

• The file owner cannot delete the reported file
• We may share the content and related account data with Dutch law enforcement (Politie), Europol, or other competent authorities
• CSAM is reported to the National Center for Missing & Exploited Children (NCMEC) as required under Dutch law (Article 240b Sr) and EU regulation
• The legal hold is lifted by an administrator once the review is complete

This obligation arises from the EU Digital Services Act (DSA), the Dutch Cybercrime Act (Wet Computercriminaliteit), and GDPR Article 17(3)(e) which explicitly exempts data from erasure where retention is necessary for legal claims or compliance with a legal obligation.

9. Privacy & Data

We collect and process personal data as described in our Privacy Policy, which forms part of these terms.

10. Governing Law

These terms are governed by Dutch law. Disputes fall under the jurisdiction of the courts of Amsterdam.

11. Changes

We may update these terms. Continued use after an update constitutes acceptance.
